Tom Cruise & Katie Holmes’ $275 Million Divorce Battle: Why Katie Could Get ‘Screwed’


Tom Cruise and Katie Holmes are about to have a divorce battle!HollywoodLife.com spoke to Vikki Ziegler, a top New York divorce attorney, who tells us that the couple who have a combined worth of $275 million are about to embark on a messy divorce.
Katie and Tom reportedly signed a prenup when they were married in 2006. According to reports, Katie will make $3 million for each year they were married — that’s $15 million. But Vikki tellsHollywoodLife.com EXCLUSIVELY that a more reasonable settlement for Katie would be 10 percent of their combined net worth, which would amount to $27 million.
“There will be some type of alimony or pay out of the assets,” Vikki tells us. “Katie could get a buyout of her portion from the assets or Tom will give her a payout. Generally speaking, celebrities have a clause for every year they are married. Even if she signed a prenup, she can say now that she was forced, or that it was unfair and try to fight it. She should fight it because’s she’s getting screwed if it’s just three million per year.”
But Divorce Court‘s Judge Lynn Toler thinks that $15 million is more than enough for Katie:
“I think $15 million is a reasonable amount for a few reasons,” she tells us. “She has her own career, so she has a means by which to maintain her lifestyle. It won’t be as good as it is with Tom though. $15 million plus child support will be significant because it will take into account the lifestyle of Suri.”
But Vikki reveals that the main way Katie can get the most money is by using her six-year-old daughter Suri’s lifestyle to her advantage!
“Most of the estate is Tom’s,” Vikki says. “She’ll have to go for a lot of child support.  She’ll have to show that Suri has nannies, cars, activities, clothes, hair appointments. That a hefty amount each month is needed to maintain Suri’s lifestyle.”
Another huge roadblock for Katie could be that since Suri was born before the couple were married in 2006, this means Tom and Katie may have a custody provision in their prenup. That means Tom might already have been granted sole custody and they might fight over custody and child support.
“Katie’s position to get full custody could be that Suri is with her all the time and obviously Tom is always working all the time,” Vikki tell us. “Katie will ask the court to have all decision making power over her.”
